Terms and Conditions: Warranty Policy for spare part/s.
Before you read the terms & conditions, we would like to inform you the following:
SPARE-HUB.DE has a fair and easy approach for tackling warranty cases. We do not aim to create barriers in order to skip the responsibility of providing our warranty service or providing to you a new spare part/s. If you truly face an unexpected experience of damaged spare part/s within the warranty period, we are more than happy to help you and provide you with a new spare part/s. The same way we are expecting fairness from your side in terms of transparency for claiming damaged spare part/s. Watch out, we are experienced in that ; ).
We believe that the experience of our warranty-service will make you appreciate the way we work since the aim of this service is to secure your purchase by sending you a new spare part/s without heavy bureaucracy.
The key condition of providing you with a new spare part within the warranty service, is mentioned in the Term Nr.3 & 5.
1. Warranty Coverage
SPARE-HUB.DE warrants that spare part/s sold hereunder including the paid extra-service of warranty will be free from defects within the purchased period of warranty-service. The spare part/s will be free from defects in material and workmanship for the period indicated in the warranty certificate, starting from the date of purchase (the "Warranty Period"). This warranty covers only the functionality of the spare part/s themselves, and does not extend to any other components or systems. This warranty service is valid only within the countries of the European Union excluding Germany.
2. Exclusions from Warranty
This warranty does not cover:
Defects caused by normal wear and tear.
Defects caused by misuse, abuse, neglect, improper storage, or improper installation.
Defects caused by modification of the spare part.
Defects caused by acts of God, such as fire, flood, or earthquake.
spare part/s identified as "used" or "reconditioned".
Labor costs for replacement or repair of spare part/s.
3. Warranty Claims & Return of Defective Parts
To make a warranty claim, you must notify (SPARE-HUB.DE) in writing within [2] days of discovering the defect. You must include a copy of your purchase invoice and a description of the defect and visible picture of the defect. SPARE-HUB.DE will then check the claim and determine whether it is covered under warranty.
If your claim is positive to be covered under the warranty service, we will ask you to send us the damaged spare part/s to our address in Germany. Once we receive your broken spare part and identify the damage on the spare part, we will immediately send you a new spare part identical to the received unit.
The customer is responsible for shipping costs of returning the damaged spare part to SPARE-HUB.DE.
SPARE-HUB.DE will be responsible for the shipping costs of the new spare part/s to you.
4. Remedies
If a spare part is found to be defective under warranty, SPARE-HUB.DE will, at its sole discretion, either:
Repair the defective spare part
Replace the defective spare part with a new or refurbished spare part
SPARE-HUB.DE is not responsible for any other damages, including but not limited to, consequential damages, incidental damages, or lost profits.
5. Limitation of Liability
THE WARRANTIES SET FORTH HEREIN ARE THE SOLE WARRANTIES PROVIDED BY SPARE-HUB.DE WITH RESPECT TO THE spare part/s, AND SPARE-HUB.DE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SPARE-HUB.DE'S LIABILITY UNDER THIS WARRANTY IS LIMITED TO THE REMEDY SET FORTH ABOVE. IN NO EVENT SHALL SPARE-HUB.DE BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SALE OR USE OF THE spare part/s, EVEN IF SPARE-HUB.DE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
6. Governing Law
This warranty shall be governed by and construed in accordance with the laws of the State of Germany.
7. Entire Agreement
These Terms and Conditions constitute the entire agreement between you and SPARE-HUB.DE with respect to the warranty service for spare part/s.
